There are 4 condition to be satisfied a)the parties must stand in near relationship b)the parties must have natural love and affection c)the agreement must be written d)the agreement must be registered under law


An agreement between husband and wife also lack the intention to create a legal relationship and thus do not result in a contract.

If it has intention to create legal relationship

If an agreement is made between parties who are in a near or close relationship, it will be legally enforceable only when it is in writing and registered under law. In all other cases, it is a domestice agreement and will not result into a contract.
