A person who is a non-resident, filed income tax return in ITR-1 form, insted of ITR-2 (for the past 3 years) by selecting residential status a "Resident" in ITR-1 by mistake. Please let me know, 1. What are the consequences for doing so? 2. Is there any process to rectify the same?

If you uses the wrong form, the income-tax officer may consider your return as defective under Section 139(9) of the IT Act.
Thanks for the reply, But the assessee didn't get any notice u/s 139(9)
