Liability for defects in BAILED goods
Corporate & Other Laws
answered on 02-Aug-23 10:12
In case of Gratuitous bailment, Bailor is liable only for those losses which arise due to non-disclosed defects But In case of Of Non gratuitous bailment, Bailor is liable for losses arised either due to disclosed defects or non-disclosed defects Why like this ? Anyone gimme a brief on this ?

Lets say for example if you visited the 5star hotel, they will take the car to park by valet. Here there is no obligation for you to pay. This we can say as gratuitous bailment, because he is not expecting any thing but you are giving your goods for a purpose, but not transferring the ownership, so if there is any loss the owner of the car is not liable to pay to the valet. But in Non gratuitous bailment lets, say for example you hired a bus for a family trip form Chennai to Bangalore, so if there is a defect in the engine or the tyre got punctured you are liable to the bus driver as the bus driver is travelling because of you, even though he discloses or not.

I didn't receive my marksheet for ca inter group 2 and my pass certificate for the exam conducted in nov 2022. What should I do? Should I apply for duplicate marksheet...? But I didn't lose my marksheet... I just didn't get it... then it is a problem from ICAI's postal services. But I guess I'm pretty late in approaching the institute.
latest answer
You can apply for duplicate marksheet and pass certificate.

Y salvage value is added to average investment formula?? Sir said, "salvage value is both at the beginning and at the end " I didn't understand this phrase .
latest answer
As the method is Average Rate of Return method.. Average investment is considered in the denominator.. Here as it is the average investment value, which is neither the full nor the salvage value and hence the average value in between these two, which is computed as (initial + salvage)/2 is taken..
