Indemnity - law
Corporate & Other Laws
answered on 18-Oct-22 16:36
In contract of indemnity,it is mentioned that ' Loss caused by accident or natural event is not covered under indemnity contract.' But Fire and Marine Insurance are covered under this. There are the losses to be caused by accident or natural event only. Then how it comes under indemnity. Kindly clarify me
latest answer
A contract by which one party promises to save the other from loss caused to him by the conduct of the promisor himself, or by the conduct of any other person, is called a contract of indemnity. Fire insurance can be caused by a person. So will be a contract of indemnity. Fire insurance coverage for say lightning would be a contingent contract.
