Mam is giving example of land as security for deposits. But there is rule where debentures or bonds ( borrowing) on which first charge is tangible asset then it fails to qualify as deposit. Can anyone please verify this. Video No: 20 Timestamp: 8:30

latest answer

That is only the case when there is FIRST CHARGE on Land AND the loan is in the form is BOND/DEBENTURE... In such case it will not be categorized as deposit. The example in the video is made with the assumption that none of the above conditions exist and that the loan is in fact a deposit as per the Act. The example is framed to make the explanation easier for the student without complicating with additional conditions.

Q.16 part (ii). The company has 10 directors of which 4 are independent. 1 independent director resigns. Now total number of Directors are 9 of which 3 are independent. As per the requirement, 1/3rd of total number of directors are to be independent, I.e. 3 in the given case. As there are 3 independent directors after one resigning, aren't the requirements met?

latest answer

Thanks a lot for your response ma'am. I understand that question is answered based on assumption that minimum requirement is 4 independent directors.
