LLPs can operate with non ca partners in line with international standards. Can anyone please explain this !!?
latest answer
A firm/LLP can partner with non-CAâ??s and still be appointed as auditor. but audit report can be signed by a CA only. Sec 141(2) states "Where a firm including a limited liability partnership is appointed as an auditor of a company, only the partners who are chartered accountants shall be authorised to act and sign on behalf of the firm."

X, Y & Z are the three partners in the partnership firm XYZ & Associates. The firm is carrying out the business of plastic toys and products. After 5 months seeing the rapid growth in the business of plastic toys and products, Z started a new business of plastic toys and products. X & Y now wants to sue Z on behalf of the partnership firm. However, Z contemplated the plea that in the absence of any agreement, Z can have its own business. Decide as per the relevant provision of the Partnership Act, 1932 (4M) (i) Whether the claim made by X & Y on behalf of the firm is maintainable (ii) What would be your answer if the agreement was written and registered.
