Income from salaries - Joining bonus
Direct Taxation
answered on 06-Mar-22 21:33
If company pays joining bonus in the previous financial year with a condition that it will be recovered if employee leaves the company within 12 months, what happens if the joining bonus is recovered in the next fiscal year due to employee leaving the organization. 1. Since tax is deducted in the previous year and tax return filed, what is the tax treatment or recovery of the tax deducted for the joining bonus which is returned in current year?
latest answer
If the employee were terminated, there will no reason for repaying the sign on bonus. If the employee were resigned even it is a less lucrative job, even in such time there will be no reduction of the taxable salary, bcoz concept of lucrative may change from person to person, like salary, designation, comfort, personal issues, etc. In my perspective, When the said case were advanced to next tier courts, it depends upon the developments of the case and evidences submitted by the parties. Good to have your doubts.

Restaurants are supplying both goods as well as services, then why it is treated only as service?
latest answer
Because Restaurants generally takes raw ingredients and make it edible(i.e. cooking) before serving to the customers. So, restaurants are like factories, must assemble raw food first, add value to it and then present it to the consumer; unlike grocery stores that provide raw food items. Thus, their supply is in the form of Service.

Generally Expenses don't have closing or opening balances, since they will be closed by transfer to the P&L A/c at the end of the reporting period. But, for your clarification, Production OH will have a Dr balance since it is an Expense to an entity.
