Does any reason behind that in case transaction not considered as transfer that transferee always be indian?

No specific rule like that. It is applicable to both resident and non resident. There are some clauses relating to non resident. For Example: Any transfer of a capital asset, being bonds or GDRs made outside India by a non-resident to another non-resident
