Is this Open Market Value
Indirect Taxation
answered on 20-Nov-21 17:45
In the attached question, ICAI assumed the price supplied to another person amounting to Rs. 297,360 as Open Market Value. My question is, it is just a price charged to another customer(this fact does not mean that it is open market value) Accordingly the value of supply should be value of consideration received + value of non monetary consideration(both excluding taxes. This is as per order of preference Under rule 27 of Valuation rules.
latest answer
It is given as sold to an unrelated person so we always assume that it is open market value.
