Charges - Sec 87
Corporate & Other Laws
answered on 08-Jul-21 00:05
1. Whether a company can file CHG-8, if company didn't register the creation or modification of charge within the extended time limit? 2. If Registrar on the own registers satisfaction of charge it will be covered under Sec.83 and if the company applies for intimating satisfaction of charge after prescribed time limit, it will be covered under Sec 87. Whether my understanding is correct?
latest answer
Both questions are practical in nature. Q 6: Company has failed to register modification so the only option it has is to make rectification to the details of registration of charge by filing form Chg - 8. Here form chg-8 is not filed to condone delay in registering the modification. In fact it is for rectification of details of registration of charge. Q 7 : In this you can mention about section 87 and application for condonation of delay in registering the satisfaction of charge. Along with that you can also state that on request from Ranjeet, ROC can use its power under section 83.

In this illustration(pic attached) we are asked to correctly prepare trail balance as on 31st march 2020, so when we are answering shouldn't we take the inventory value as on 31.03.2020(refer the lines below the question) instead of inventory on 1.4.2019(which is in table). However in solution they took inventory value as on 1.4.19 which is actually previous year's detail. Kindly explain. Thankyou.
latest answer
Sir, the given inventory is opening inventory the goods which are not sold last year it's essential to show the previous years stock in our accounts and the second thing you were talking about is closing inventory, yes we take it in the books of accounts but in this case it will be in adjustment part (hope you know final accounts) as to make a dual effect it is a part of adjustment
