We can link to the essential element intention to create legal relationship and state that no valid contract has actually come in existence. On the contrary, if we look at the second statement which says the contract shall not be subject to any legal jurisdiction..We can also use the provision of agreement in restraint of legal proceedings and state that the agreement is void. For the purpose of writing answer to this question, any of the above provisions can be used and whichever provision you are using you will have to mention about that in your answer.
