subsidy valuation
Indirect Taxation
answered on 27-Mar-21 10:20
I have attached copies of an illustration from the institute material. The question states that a subsidy from a NGO of rupees 2000 has been received and the price of the goods is after consideration of such subsidy received. As the question has given that it is after considering subsidy, we cannot add it one more time with the price. But in the material, they have added such subsidy to the price. Please clarify it to me if i am wrong.
latest answer
Section 15(2)(e) states that Value of Supply shall include subsidies directly linked to the price excluding subsidies provided by the Central Government and State Governments. So subsidy received from NGO in the present illustration is taxable as it is not from Govt.. "Price of the goods is after consideration of such subsidy received" means that 50,000 is net of subsidy received, hence 2000 is added to the value of supply

Please any one explain TENANCY RIGHTS undar GST CBIC circular 44/18/2018
latest answer
Apart from the right to live in the property, the owner may give the tenant a right to sell his tenancy right to a third party. Here, tenancy right would mean the right to live in/ use this property. The tenant pays some amount to get this right and become a part owner of the house/property alone and not the land. Tenancy premium amount paid by the owner of the property to the tenant, to leave the property before the time it was agreed between them. Transfer of Tenancy Rights for Tenancy premium is considered as supply it will be taxable under GST. GST will be applicable even in cases where stamp duty and registration fees are paid. The tenancy premium given to the tenant (outgoing tenant) will be taxable under GST.
