Auction sale

Corporate & Other Laws

answered on 03-Mar-25 15:35

1)since madhu is bidding on the behalf of the auctioneer then why in second case the sale becomes lawful it is unlawful right?? 2)In first case why MR DEV is rejected this is confusing and not understandable

latest answer

If the right to bid is not notified, it only means the seller cannot bid or appoint someone to bid; public participation is still allowed. RN Association, being the auctioneer and not the seller, cannot bid or direct someone to bid on its behalf. Section 64 applies only to the seller and restricts bidding unless expressly notified. In the second case, if Mr. Dheer was a genuine bidder and not acting for the seller, the sale is lawful. If the seller had bid without notifying the right to bid, the sale would be fraudulent under Section 64.

Auction sale sec 64

Corporate & Other Laws

answered on 27-Feb-25 14:36

1)If right to bid not notified then only invited people are only entitled to participate in bid ?? 2)RN ASSOCIATION is auctioneer. So, he has right to bid or direct any person to bid on behalf of RN ASSOCIATION right? As per sec(64) only for the seller the right to bid notified right, if yes then in second case sale must be lawful right? I need clarification on this case for both two doubts?

latest answer

Section 64 restricts only the seller from bidding unless the right to bid is expressly mentioned. Since RN Association is just the auctioneer and not the seller, this rule does not apply to them. If the seller or someone on their behalf had bid without notification of the right to bid, then it would be unlawful. However, if the buyer (Mr. Dheer) was a genuine bidder and not acting on behalf of the seller, the sale is lawful.
